By accessing and using CloudCommerce ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.
CloudCommerce reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service shall be subject to the Terms of Service.
1.5 User Content Rights
User Content. You represent and warrant that you own or have the necessary rights, licenses, and permissions to submit any content you upload or provide to the Service, and that such content does not violate any third-party rights or applicable laws.
2. Account Terms
- You must be 18 years or older to use this Service.
- You must be a human. Accounts registered by bots or automated methods are not permitted.
- You are responsible for maintaining the security of your account and password.
- CloudCommerce cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
- You are responsible for all content posted and activity that occurs under your account.
3. Payment Terms
A valid credit card or approved payment method is required for all paid plans. Free accounts are not required to provide credit card information.
All fees are exclusive of applicable taxes unless otherwise stated. You are responsible for payment of all taxes.
For monthly subscriptions, the Service is billed in advance on a monthly basis and is non-refundable except as required by law or as stated in our refund policy.
4. Cancellation and Termination
You may cancel your account at any time by contacting support or through your account settings. Cancellation is effective at the end of your current billing period.
CloudCommerce reserves the right to suspend or terminate your account if you violate these Terms of Service or engage in fraudulent activity.
4.5 Prohibited Conduct
Prohibited Conduct. You may not use the Service to scrape, copy, harvest, or reproduce third-party websites, applications, or proprietary design libraries in a manner that violates their terms or intellectual property rights.
No Cloning. The Service is intended to generate original work product. You may not request or use the Service to replicate third-party products pixel-for-pixel or otherwise produce materially similar copies of proprietary designs without proper authorization.
5. Intellectual Property
The Service and all content, features, and functionality are owned by CloudCommerce and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. The AI-powered design assistant generates code based on general UX patterns and design principles, not proprietary third-party content.
6. Limitation of Liability
CloudCommerce shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.
